TERMS OF USE
These Terms of Use (“Terms”) govern the use of SKY Schools Website and Apps (“Service”) and govern the relationship between you (“You” or “User”) and SKY Schools, (“SKY Schools” or “We”) regarding your use of the Service. By accessing or using the Service You agree to the Terms and accept to be bound by them. These Terms affect your legal rights and obligations, so if you do not agree to the Terms, do not use the Service.
You become a registered user of the Service and create a Service account (“Account”) by (i) using your personal unique email address and giving other information required;
1. Rights & Obligations
The Service is licensed to you for your personal, educational and non-commercial use only. Your use of the Service might be governed also by separate policies, as provided in connection with such services. SKY Schools grants to you a limited, non-exclusive, non-sublicensable and non-transferable right to use only the executable version (no source code) of the Service application for your private use. The Service comprises the relevant application that enables you to use the Service. You affirm that you have not been previously suspended or removed from the Service. You may not sell or charge others for the right to use Your Account, or otherwise transfer Your Account.
If you download an application for accessing the Service, You may not use such application for any purpose other than the permitted access to the Service. You understand that for reasons that include, without limitation, system security and stability, Service may need to automatically update, pre-load, create new versions or otherwise enhance the application and accordingly, the system requirements to use the application may change over time.
2. iPhone App Subscription
Currently, use of the SKY App is exclusive through agreement to schools and organizations in current, active contractual agreements with SKY Schools & the International Association for Human Values.

3. Intellectual property
The Service (including the related software and media), the design of the Service and associated content including text, scripts, graphics, interactive features and the like, and the trademarks, service marks and logos contained therein (“SKY Schools Property”) are owned by or licensed to SKY Schools, subject to copyright and other intellectual property rights under laws and international conventions. Except as expressly provided in these Terms, SKY Schools does not grant any express or implied rights to use SKY Schools Property. SKY Schools may make available to users, for free or upon payment, additional content in the Service, such as videos or pictures or coaching (“Additional Content”).You are hereby granted a limited, nonexclusive, non-sublicensable and non-transferable license to access and use the SKY Schools Property and Additional Content only in connection with the usage of the Service. Any use of the Service, SKY Schools Property or Additional Content other than as specifically authorised in the Terms, is prohibited and will terminate the license to use the same. For avoidance of doubt, You have no right to make available to third parties any content originating from the Service.
4. Third-Parties
The Service may contain links to websites or applications operated by third parties or feature content which is made available in third-party services and enable you to access and use certain third-party services. Use of any web sites or applications operated by third parties, third-party services and/or content in third-party services shall be subject to the relevant third-party service provider’s terms and conditions applicable to use of such third-party services or the applicable license(s) under which any such content is made available. SKY Schools assumes no responsibility for such third-party services and/or content in third-party services.
5. Costs
The Service and any Additional Content shall be available to you upon the payment of the relevant fees stated in connection with the service. By placing your order concerning your use of the Service during the applicable billing period or purchasing any Additional Content, and providing a payment method, You authorise Us to charge you at the applicable fees in accordance with SKY Schools’s schedule of fees. Save for your statutory right to cancel your order, payments are non-refundable and there are no refunds or credits for partially used billing periods.
Certain purchases made in connection with the Service are final and non-refundable. In the event that the provision of additional features to the Service and/or material for use in the Service (e.g. any Additional Content that You may download upon separate purchase) is a Service that commences immediately upon acceptance by SKY Schools of your purchase. No refund of any fees shall be available, save for as provided above.SKY Schools has right to change the price of the Service at any time. Such change will not affect already paid service fees.
6. Security
You shall give to SKY Schools correct personal and other information necessary for the use the Service. You shall inform SKY Schools of any changes to such information. Use of your personal and other information is governed by SKY Schools Privacy Policy, which is incorporated herein by reference. SKY Schools shall take appropriate online and physical measures to prevent unauthorised access to, improper use of and the reasonable accuracy of your personal data submitted to SKY Schools via the Service. We use various technologies, including, in certain instances, encryption, to ensure the high security standards. Any data that is stored on SKY Schools servers is not generally available to the public. However, the use of internet services always includes security risks. You shall be liable for all your own equipment, internet connectivity and software as well as that they do not cause harm to SKY Schools and/or third parties. You agree to not attempt to damage, hack, crack, reverse engineer, or otherwise interfere with the Service in any manner.
7. Support
SKY Schools shall have no obligation to provide support or maintenance for the Service under this agreement. SKY Schools may, at its sole discretion, provide limited technical support for the Service. You understand that the Service is an evolving one. As long as your license for the service is valid you are entitled to upgrades or updates of the service. All upgrades and updates are provided to you on a license exchange basis. You agree that by using an upgrade or update you voluntarily terminate your right to use any previous version. SKY Schools may license upgrades and updates to you with additional or different terms. You may need to update third party software and/or upgrade your equipment from time to time in order to use the Service.
8. Warranty
To the maximum extent permitted by applicable law, except as provided above, SKY Schools makes no warranty or representation either expressed or implied with respect to the service, its quality, performance or fitness for a particular purpose. The service and all content is provided to you strictly on an “as is” Basis, except in cases where defects have rendered use of the service is impossible.
9. Compensation
You agree to defend, indemnify and hold harmless SKY Schools, its affiliates, licensors, partners and subcontractors from all liabilities, claims and expenses, including reasonable attorneys' fees, arising from or related to your breach of the Terms and Conditions or portion hereof, or any act or omission by You relating to the service (including User Content). SKY Schools reserves the right to assume its own defence and/or control of any matter otherwise subject to indemnification by You hereunder.
10. Liability limitation
You understand and acknowledge that SKY Schools will not be liable for any network-related problems attributable to the operation of the Service and that network configuration changes may affect the system's performance. You acknowledge and agree that SKY Schools shall have no liability arising from your use of the service, as set forth herein.
11. Termination
SKY Schools shall have the right to, at its sole discretion, decide upon provision of the Service and making it available to you and reserves the right to discontinue any aspect of the Service at any time. These Terms are in effect for the time being. Your right to use the Service continues until your right to use the Service is terminated. You may terminate your right to use the Service at any time by ceasing to use the Service. Your right to use the Service will automatically terminate if You fail to comply with the material terms of the Terms. In such cases You will not be entitled to any refund.
12. General Information
SKY Schools may assign or delegate its rights and obligations under the Terms and/ or the SKY Schools Privacy Policy, in whole or in part, to any person or entity at any time. You may not assign or delegate rights or obligations under the Terms or Privacy Policy without SKY Schools’s prior written consent. These Terms describe certain legal rights. You may have other rights under the mandatory provisions under the laws of your country. These Terms do not change your rights under the mandatory provisions under the laws of your country. You and SKY Schools agree that if any portion of the terms or if the SKY Schools Privacy Policy is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without the remaining provisions of the Terms, which shall continue to be in full force and effect. SKY Schools may publish additional policies related to specific services. Your right to use such service is subject to those specific policies and the terms. SKY Schools reserves the right to change, modify, add or remove portions of the Terms and its Privacy Policy at any given time by posting the amended Terms on the service, and in case of substantial changes, by email to the email address provided by You to SKY Schools. You will be deemed to have accepted such changes by continuing to use the Service. If You do not agree to any portions of the then-current version of our terms, SKY Schools Privacy Policy, or any other SKY Schools policy, rules or codes of conduct relating to your use of the service, Your license to use the service shall immediately terminate, and You must immediately stop using the service, and You will not be entitled to any refund of the service fee. SKY Schools (”SKY Schools”, “We” or “Us”) respects Your privacy and is dedicated to protecting the privacy of those persons using (“User(s)” or “You”) the SKY Schools webpages and other services and applications provided by SKY Schools (“Services”). In order to enhance the service SKY Schools may use tools from third party service providers, such as Google Analytics or Mix Panel to collect and use non-personal information. Google Analytics collects and stores data such as time of visit, pages visited, time spent on each page of the Site, the Internet Protocol (IP) address, and the type of operating system used in the devices used to access. SKY Schools may collect information on Users’ activities in the Services, such as purchase history and attended yoga classes. We may feature advertising within the Services, and may employ third party technologies to collect information in the Services. Advertising may be based on your user profile in order to provide personalized advertisements that, and advertising in the Service may come from affiliate advertising networks. You may also share data from your Apple iOS Health App ("Health App") with us. It's up to you what you information is passed to the Health App and you can modify which apps can access your data in your iPhone settings. We will never use your Health App Data for any other purpose than improving your health, medical and fitness management from within the SKY Schools app, and will never share your Health App Data with third parties.
3. Hosting information
By using the Services You always disclose information about yourself to SKY Schools. In connection with Your use of the Services, including communication in the Services, You will disclose data about yourself to other users, and any such data is public information, and there is no expectation of privacy. SKY Schools is not responsible for any personal data you choose to make public in the Services. SKY Schools will not disclose your stored Personal Information to third parties for direct marketing, market research, polls or public registers without Your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt- out. SKY Schools shall not be responsible for any processing of Personal Information by third parties. The Personal Information might be used for targeted in- service marketing and other similar purposes, and upon Your consent, to email marketing by SKY Schools. We may use external service providers to provide technical solutions or services for processing stored information and access the stored information by using a technical interface and share Your personally information with third party service providers to the extent that it is reasonably necessary to perform, improve or maintain the Services. SKY Schools may use third party service providers, such as e-mail service providers, credit card processors, information analyzers and business intelligence providers. SKY Schools has right to share Personal Information as necessary for the aforementioned service providers to provide their services to SKY Schools. SKY Schools is not liable for the acts and omissions of these third parties. We may share non-personal information (such as anonymous User usage data, referring / exit pages and URLs, platform types, asset views, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality of the Services. In exceptional circumstances Personal Information may be disclosed to third parties if required under any applicable law or regulation or order by competent authorities, or in order to enforce the Terms and Conditions of the Services and to investigate possible infringing use of the Services as well as to guarantee safety of the Services. Your acknowledge and agree that SKY Schools may host the Services in and transfer information for this purpose to countries outside the European Union or the European Economic Area or the United States of America in accordance with mandatory legislation and this Privacy Policy.

The register will be maintained in external service providers’ servers with appropriate safeguards, such as password protection, granting the access to the stored information only to SKY Schools, persons working at SKY Schools or SKY Schools partners who are expressly authorized by SKY Schools. The register is protected by appropriate industry standard, technical and organisatory safety measures. The database will be accessible only to those persons expressly authorized by SKY Schools. Although We make good faith efforts to store the information collected on the services in a secure operating environment that is not available to the public, We cannot guarantee the absolute security of that information during its transmission or its storage on our systems. SKY Schools will post a notice on the SKY Schools website or through the Services in case material security breach that endangers Your privacy or Personal Information. SKY Schools may also temporarily shut down a service to protect Personal Information.
5. Tracking

SKY Schools uses cookies to help it identify and track visitors, their usage of the Services, and their access preferences, improving quality, tailoring recommendations, and developing the Services. Please note, the Services may not work properly if We are unable to tell where You are coming from (Country specific).

Users are entitled to review any information collected on him/her and stored in the register. When User wishes to use the above right to review stored information, User should send a signed request thereof to SKY Schools using the contact details below. We will, at our own initiative or upon a User’s request, complement, correct or delete incomplete, inaccurate or outdated Personal Information. You may opt-out of receiving promotional emails by following the instructions in those emails.
